This privacy policy (the "Policy") of Les Librairies indépendantes du Québec, coopérative and the Association pour la promotion de la librairie indépendante ("Les Libraires", "we", "us", "our") applies to the websites accessible at leslibraires.ca, revue.leslibraires.ca and quialu.ca (collectively, the "Platforms"). 

Nothing in this Policy creates obligations for Les Libraires beyond those imposed by applicable privacy laws and regulations. In addition, we wish to draw your attention to the fact that the rights and obligations described in this Policy do not cover third-party websites that may be linked to or mentioned on our Platforms. These third-party websites have their own privacy policies and we encourage you to read them carefully.

In this Policy :

"Personal Information" means any information or material which relates to a natural person and enables that person to be identified or which, individually or in combination with other information or material, enables that person to be identified.

"You" refers to you as a customer of Les Libraires or as a user of any of its services (the "Services") via the Platforms. This Policy covers the following aspects of the protection of personal information:

  2. PURPOSES: The purposes for which Personal Information is collected will be identified by Les Libraires at or before the time of collection.
  3. CONSENT: Your consent to the collection, use and disclosure of your Personal Information is required, unless otherwise specified by applicable law.
  4. LIMITS OF COLLECTION: The collection of personal information shall be limited to the purposes identified by Les Libraires. Information will be collected by fair and lawful means. Les Libraires will collect a certain amount of Personal Information.
  5. LIMITS ON USE, DISCLOSURE AND RETENTION: Personal Information will not be used or disclosed for purposes other than those for which it was collected, except with your consent or as required by law. Personal Information will be retained only as long as necessary for the fulfillment of those purposes.
  6. ACCURACY: Personal information shall be as accurate, complete and up-to-date as is necessary for the purposes for which it is to be used.
  7. SECURITY MEASURES: Personal information will be protected by security safeguards appropriate to the sensitivity of the information.
  8. TRANSPARENCY: Les Libraires will make readily available accurate information about its policies and practices relating to the management of Personal Information.
  9. COOKIES: Les Libraires uses cookies for certain functions, in particular to personalize the content presented to you on the Platforms.
  10. ONLINE ADVERTISING: We use your Personal Information to provide you with targeted advertisements or Messages that we believe may be of interest to you, including advertisements for particular services and products. 
  11. HOSTING AND TRANSFER OF YOUR PERSONAL INFORMATION: Les Libraires may store or use subcontractors to process your Personal Information in locations other than your province or territory of residence, including Quebec and the United States. 
  12. YOUR RIGHTS: Upon request, you will be informed of the existence, use and disclosure of your Personal Information and will be given access to that information. You will be able to challenge the accuracy and completeness of the Personal Information and have it amended as appropriate, as well as the right to portability of your Personal Information. 
  13. POSSIBILITY OF LODGING A COMPLAINT ABOUT NON-COMPLIANCE WITH THE PRINCIPLES: You may challenge Les Libraires' compliance with this Policy by contacting our Privacy Officer. 
  14. MODIFICATION OF THE POLICY: Les Libraires may modify, revise or supplement this Policy, at its sole discretion, to reflect changes in Les Libraires' privacy practices.

POLICY CONTENT

1.    RESPONSIBILITY

Les Libraires has designated a Privacy Officer who is accountable for Les Libraires' compliance with this Policy.

Accountability for Les Libraires' compliance with the Policy rests with the Privacy Officer, although other individuals within Les Libraires may be responsible for the day-to-day collection and processing of Personal Information. Other individuals within Les Libraires may also be delegated to act on behalf of the Privacy Officer. 

2.    PURPOSES

The purposes for which Personal Information is collected will generally be identified by Les Libraires at or before the time of collection.

Les Libraires will document the purposes for which Personal Information is collected. Depending on the manner of collection, this may be done orally or in writing. For example, an online request form may state these purposes.

Identifying the purposes for the collection of Personal Information at or before the time of collection allows Les Libraires to determine what Personal Information is required to fulfill those purposes. Les Libraires will only collect Personal Information that is necessary for the purposes identified. Unless a new purpose is required by law, Les Libraires will obtain the consent of the individual before using the Personal Information for the new purpose. The purposes for which Les Libraires collects your Personal Information include:

  • To provide, maintain, personalize and improve the Services, for example, by tailoring our content to your interests;
  • To enable Les Libraires to carry out internal operations in connection with its Services; 
  • Send or facilitate communications between Les Libraires or its affiliated bookstores and you in connection with the Services;
  • Create and manage your account (if applicable);
  • Contact you to provide customer support;
  • Respond to your requests for information; 
  • Examine orders for risk and potential fraud

(collectively, the "Purposes").

Les Libraires may send you newsletters, electronic messages such as e-mails, news, updates, contests, special offers and/or other written communications ("Messages") about Les Libraires' services and/or the products and/or services of its affiliated bookstores. You may choose not to receive Messages through the unsubscribe link included in Messages. However, Les Libraires may continue to send you Messages to inform you of available upgrades or critical technical issues related to the Platforms, Services and products you have requested or purchased, or to provide you with important account information (if applicable).

Les Libraires may also aggregate and anonymize the Personal Information you have provided, in order to create statistical data that Les Libraires may use to improve the Platforms, examine purchasing trends and user interests, or train machine learning algorithms. Les Libraires may also share this information with its third-party partners. This statistical data does not include any Personal Information.

3.    CONSENT

Your consent to the collection, use and disclosure of your Personal Information is required, unless otherwise specified by applicable law. For example, for legal, medical or security reasons, it may be impossible or impractical to obtain consent.

Generally, Les Libraires will obtain consent at or before the time of collection. In certain circumstances, however, consent to use or disclose Personal Information may be obtained after collection but before use (for example, when Les Libraires wishes to use Personal Information for a purpose not previously identified).

Les Libraires will not, as a condition of the supply of a good or service, require consent to the collection, use or disclosure of Personal Information beyond that required to fulfill the Purposes identified. The manner in which Les Libraires seeks consent may vary depending on the circumstances and the type of Personal Information collected. In general, Les Libraires will seek express consent if the Personal Information is likely to be considered sensitive. Implied consent will generally be considered sufficient where the Personal Information is of a less sensitive nature. Consent may also be given by an authorized representative (such as a legal guardian or a person holding a written power of attorney). Consent will not be obtained by subterfuge.

You can consent in several ways, for example:

  • An online request form may be used to obtain consent, collect Personal Information and inform you of the use that will be made of your Personal Information. By completing and returning the form, you consent to the collection and use of the information specified;
  • A box can be used to allow you to expressly accept that your name and address be communicated to other organizations; 
  • Consent may be given orally when Personal Information is collected by telephone; or
  • Consent may be given at the time a product or service is used.

You may withdraw your consent (if any) to the processing of your Personal Information in our possession by contacting us at any time, subject to legal or contractual restrictions and reasonable notice. You should be aware, however, that if you choose not to provide us with your Personal Information, this may prevent you, for example, from using the Platforms, as this information is essential to such use. Generally, Les Libraires will collect Personal Information from you only, unless you consent to its collection from third parties or it is otherwise permitted by law. It may also do so if it has a serious and legitimate interest and if either of the following conditions is met: (i) the Personal Information is collected for your benefit and cannot be collected from you in a timely manner; or (ii) collection from a third party is necessary to ensure the accuracy of the Personal Information.

4.    LIMITS OF COLLECTION

The collection of Personal Information will be limited to the Purposes identified by Les Libraires. Information will be collected by fair and lawful means.

Les Libraires will specify the type of Personal Information collected as part of its information management policies and practices. Personal Information collected may include, but is not limited to: 

  • Your first and last name, billing address, shipping address, e-mail address, telephone number, certain credit card information (including credit card numbers, credit card security numbers, credit card expiration dates and/or other payment details provided by Paypal or Braintree), and order history, in order to identify you, provide products and services to you, and correspond with you;
  • Your login information, such as your first and last name, e-mail address and password;
  • Marketing information and communication preferences, as well as feedback and survey responses;
  • Any other Personal Information you provide to us.

5.    LIMITS ON USE, DISCLOSURE AND RETENTION

Your Personal Information will not be used or disclosed for purposes other than those for which it was collected, except with your consent or as otherwise required by law. Personal Information will be retained only as long as necessary for the fulfillment of those Purposes. At the end of this period, we will endeavour to destroy or anonymize such information.

Your Personal Information will not be used or disclosed for purposes other than those for which it was collected, except with your consent or as otherwise required by law.

Disclosure limits

In the course of their work, our employees may need to access your Personal Information, for example, when you contact us or request assistance. Their access is limited to what is necessary for the performance of their duties. Les Libraires may share your Personal Information with its partners to facilitate its activities, such as developers, payment and hosting service providers. As part of these activities, these partners may have access to and use of your Personal Information for a limited period of time. Where Les Libraires engages third parties to process any Personal Information, Les Libraires endeavours to implement commercially reasonable contractual and technical safeguards to ensure that such third parties keep all Personal Information they process strictly confidential. 

We may also share your Personal Information with third parties if necessary to comply with applicable laws and regulations or if we believe in good faith that such action is necessary to: (i) comply with the law; (ii) comply with an order of a competent judicial authority in any jurisdiction; (iii) comply with legal process served on Les Libraires; (iv) protect and defend the rights or property of Les Libraires; (v) enforce or verify your compliance with any agreement you have entered into with Les Libraires, if any; (vi) prevent fraud or other illegal activity perpetrated through the Platforms; or (vii) act in urgent circumstances to protect the personal safety of users of the Platforms or the general public.

We may share your Personal Information without your authorization when our operations require it (in the event of a merger, acquisition, bankruptcy or sale of assets, for example). In such circumstances, we may also share some or all of your Personal Information with the relevant third party (or its advisors) for the purposes of a due diligence process.

Where you have expressly consented, your Personal Information may be shared with other third parties. For example, there may be specific cases where additional conditions apply and, through these, we make it clear that specific third parties are processing your Personal Information.

Retention limits

Les Libraires has guidelines for the retention and destruction of Personal Information. These guidelines specify minimum and maximum retention periods. In determining the appropriate retention period and guidelines for your Personal Information, we take into account the amount, nature and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the Purposes for which we process your Personal Information and the possibility of achieving those Purposes by other means, as well as any applicable legal, regulatory, tax, accounting or other requirements. 6.    ACCURACY

Personal Information shall be as accurate, complete and up-to-date as is necessary for the Purposes for which it is to be used.

Les Libraires will ensure that Personal Information is current and accurate at the time it is used for the Purposes. Thus, Personal Information that is used on an ongoing basis, including Personal Information that may be disclosed to third parties, will generally be accurate and up-to-date.

The accuracy, currency and completeness of Personal Information will depend on the input of: (i) your data; (ii) data generated by your use of Les Libraires' products or services; and (iii) the use of Personal Information, taking into account your interests. 

7.    SECURITY MEASURES

Les Libraires strives to protect your Personal Information according to its sensitivity.

Les Libraires strives to adopt security measures necessary to ensure the protection of Personal Information collected, used, disclosed, held or destroyed.

Les Libraires' security measures are designed to protect Personal Information against loss or theft, as well as unauthorized access, disclosure, copying, use or modification.

The nature of the safeguards will vary depending on the type and sensitivity of the Personal Information collected, the amount, distribution and format of the Personal Information, and the method of storage. 

Protection methods include: (i) physical measures (e.g. restricting access to offices); (ii) administrative measures (e.g. security clearances); and (iii) technical measures (e.g. the use of passwords).

Les Libraires will make its staff aware of the importance of protecting the confidentiality of Personal Information and particular care will be taken at the time of destruction of Personal Information (if any), to prevent unauthorized persons from gaining access to it.

The Platforms are only available and designed for individuals 14 years of age or older. If you believe that Personal Information has been collected from individuals under the age of 14, or if you are a parent or legal guardian and believe that your child under the age of 14 has provided us with Personal Information, we invite you to contact us at the coordinates set forth in the "Personal Information Management" section.

8.    TRANSPARENCY

Les Libraires will make readily available accurate information about its policies and practices relating to the management of Personal Information.

Les Libraires strives to be transparent about its policies and practices relating to the management of Personal Information. You may obtain information about Les Libraires' policies and practices by contacting us as indicated in the "Personal Information Management" section.

The information provided will include:

  • Contact information for the Privacy Officer responsible for Les Libraires' Policy and practices and to whom complaints and inquiries should be forwarded;
  • A description of how you can access your Personal Information held by Les Libraires and your rights to rectify or withdraw consent to the disclosure or use of your Personal Information;
  • A description of the type of Personal Information held by Les Libraires, including a general explanation of the purposes for which it is used;
  • Personal information that is communicated to related organizations (e.g. affiliated bookstores) or collected by third parties and the possibility that it may be shared outside Quebec;
  • The Purposes for collecting such Personal Information;
  • The means used to collect such Personal Information;
  • The length of time Personal Information is retained by Les Libraires; and 
  • The categories of persons who have access to Personal Information within Les Libraires. 

9.    COOKIES

Les Libraires uses cookies for certain functions, in particular to personalize the content presented to you on the Platforms.

A cookie is a small text file that is stored in a dedicated location on your computer, mobile device, tablet or other device when you use your browser to visit an online service and saves a small amount of information when you visit our Platforms. Other tracking technologies, such as web beacons, log files, tags and tracking pixels may be used for similar purposes. In this Policy, all such tracking technologies are collectively referred to as "Cookie(s)". Any Personal Information collected using Cookies by or on behalf of Les Libraires is treated with the same level of confidentiality as any other Personal Information collected by or on behalf of Les Libraires.

Strictly necessary cookies

These Cookies are necessary for the operation of the Platforms and cannot be deactivated in our systems. Strictly necessary Cookies must be present in order for the Platforms to perform their basic functions, which may include logging in, adding items to a shopping cart or electronic invoicing. In particular, they enable a user to navigate from one page to another without losing previous actions in the same session. 

Non-essential cookies

Les Libraires and/or its third-party partners may also use non-essential Cookies in connection with the Platforms and Messages:

  • Functionality cookies: These cookies are not essential to the provision of our services. They enable us to personalize and improve the user experience. For example, these cookies store your communication preferences.
  • Analytical Cookies: We may use analytical Cookies to better understand traffic patterns on the Platforms, to help us measure and improve the effectiveness of our services and Messages, and to determine whether Messages have been opened and links clicked. These Cookies are used for statistical purposes only. All information collected by these Cookies is aggregated and anonymous. In addition, our partners may use these Cookies to determine whether our advertisements have been displayed to you and whether you have interacted with them. Using reCAPTCHA

Les Libraires uses Google's reCAPTCHA service to protect form entries on the Platforms. Google reCAPTCHA is used to verify whether data entered on our Platforms has been entered by a human or by an automated program. In other words, this service enables us to distinguish between humans and computers, so that robots are unable to fill in forms maliciously. For more information, please visit the Google reCAPTCHA website and read their privacy policy. By using the reCAPTCHA service, you consent to the processing of data about you by Google in the manner and for the purposes set out in their policies.

10.    ONLINE ADVERTISING

We use your Personal Information to provide you with targeted advertisements or Messages that we believe may be of interest to you, including advertisements for particular services and products. 

We share with our advertising partners information about your use of the Platforms, your purchases and your interaction with our advertisements on other websites. This Personal Information is collected using Social Media Cookies and/or Advertising Cookies, as described above in the "Cookies" section. Some of this Personal Information will be shared directly with our advertising partners.

Under no circumstances will Les Libraires allow advertising to children when it has actual knowledge that the user is under the age of 14. To learn more about Les Libraires' advertising practices, please contact our Privacy Officer. 

Internet browsers can transmit "Do Not Track" ("DNT") signals, which indicate that a user does not wish his or her activity to be tracked over time and across different websites. At present, there is no universally accepted standard on how to interpret these signals, although work to create a consensus is underway. Consequently, we do not respond to these DNT signals.

11.    HOSTING AND TRANSFER OF YOUR PERSONAL INFORMATION

Les Libraires may store or use subcontractors to process your Personal Information in locations other than your province or territory of residence, including Quebec and the United States.

Your Personal Information may be held by Les Libraires in locations other than your province or territory of residence, including Quebec and the United States. Les Libraires may also subcontract the processing of your Personal Information or share it with third parties located elsewhere, including in places other than your province or territory of residence. In such cases, Les Libraires will ensure that your Personal Information is adequately protected by appropriate technical, organizational, contractual or other legal means. 12.    YOUR RIGHTS

Upon request, you will be informed of the existence, use and disclosure of your Personal Information and will be given access to that information. You will be able to challenge the accuracy and completeness of the Personal Information and have it amended as appropriate. You will also have the right to de-index your Personal Information, as well as the right to data portability, that is, the right to receive a copy of all Personal Information that Les Libraires holds about you in a structured, commonly used and machine-readable format.

Upon request, Les Libraires will inform you if it holds any Personal Information about you and may indicate the source of such information. Generally, Les Libraires will provide you with access to such Personal Information. You may be required to provide sufficient information to enable Les Libraires to provide you with an account of the existence, use and disclosure of Personal Information.

You have the right to have Personal Information about you corrected if it has been collected in an unlawful manner.

A request for access, rectification, portability, de-indexation or deletion can only be considered if it is made in writing by you and you are able to prove that you are the person concerned by the request (or his or her representative, the heir or successor of the person concerned, the liquidator of the estate or the beneficiary of life insurance or death benefits, the holder of parental authority even if the child is deceased, or the spouse or close relative of a deceased person, when knowledge of the Personal Information is likely to help the spouse or close relative in his or her grieving process and the deceased person has not recorded in writing his or her refusal to grant this right of access.).

In some situations, it may not be possible for Les Libraires to accommodate your request. Exceptions to access requirements are limited and specific. The reasons for denying access will be provided along with the recourse available to you and the time limit for exercising it. Exceptions may include information the transmission of which raises serious practical difficulties, information containing details concerning other persons, or the existence of legal, security or commercial reasons preventing the transmission of the information. 

Les Libraires may refuse to provide you with Personal Information where disclosure of such Personal Information would likely hinder an investigation aimed at the prevention, detection or repression of crimes or statutory offences or legal proceedings in which Les Libraires, or you, would have an interest. Les Libraires will refuse to disclose Personal Information to you where: (i) disclosure would reveal Personal Information about a third party or the existence of such Personal Information; and (ii) disclosure would be likely to cause serious harm to that third party, unless the third party consents to disclosure of the Personal Information or there is an emergency threatening the life, health or security of an individual. A reasonable fee may be charged for the transcription, reproduction or transmission of Personal Information.

13.    POSSIBILITY OF LODGING A COMPLAINT ABOUT NON-COMPLIANCE WITH PRINCIPLES

You may challenge Les Libraires' compliance with this Policy by contacting our Privacy Officer.

Les Libraires has established procedures for receiving complaints and inquiries about its policies and practices relating to the management of Personal Information. The complaints procedure is easily accessible and simple to use.

Les Libraires will inform persons making inquiries or complaints of the existence of the relevant procedures.

Les Libraires will investigate all complaints. If a complaint is found to be justified, Les Libraires will take appropriate measures including, if necessary, modifying its policies and practices.

When a complaint is not resolved to your satisfaction, the content of the unresolved complaint will be recorded by Les Libraires.

14    MODIFICATION OF THE POLICY

Les Libraires may, at its discretion, update, revise, modify or supplement this Policy from time to time to reflect changes in its practices or for other operational, legal or regulatory reasons. If material changes are made to the Policy, you will be notified when you visit the Platforms and/or we will send you a link to the new version of the Policy. The Policy and any related documents will be posted on our Platforms. Les Libraires asks its users to review and accept the revised Policy before continuing to use the Platforms.
